Watch: Will video exonerate Maximum Security jockey Saez?

Luis Saez has stated his case. Now the waiting begins.

Aided by a video presented Friday by his attorney, Ann Oldfather, in a meeting with Kentucky Horse Racing Commission stewards, Saez could face additional sanctions following Maximum Security’s disqualification in last weekend’s Kentucky Derby.

The video seeks to further illustrate an argument first made by Gary West, who bred and campaigns Maximum Security, with his wife, Mary. West says War of Will and jockey Tyler Gaffalione — who trailed his colt through the far turn at Churchill Downs — interfered to the point that Maximum Security veered out from the rail, leading to his DQ.

The video features NBC’s replay of the Kentucky Derby and points the paths taken by various contenders as quarters became close before they reached the 5/16ths pole. As Maximum Security moves out into traffic, the video asks, “What happened in the 5 seconds before this frame?

“Was it intentional by Luis? Or a distracted young horse?”

In this case, Saez's camp wouldn't be looking to debate the disqualification, only whether the 27-year-old jockey intentionally shifted Maximum Security, or should have better controlled the colt.

An early portion of the video also points to a now-deleted tweet from Gaffalione in which he says he was “anticipating a spot” with War of Will. “You can clearly see Luis Saez is pulling him back in," Gaffalione added. "You have to remember this all happens in a matter of seconds going 40 mph.”

Later, the video seeks to prove contact between War of Will and Maximum Security caused the move, not any actions taken by Saez. Gaffalione, trainer Mark Casse and owner Gary Barber have all denied War of Will interfered with Maximum Security.

If stewards deem further punishment is warranted, Saez could face a suspension or fine. Attempts to reach KHRC stewards Friday were unsuccessful. Sanctions are typically listed promptly on the racing commission's website.
