Report: Judge dismisses Hollendorfer’s case against CHRB
A California judge ruled that Hall of Fame trainer Jerry Hollendorfer’s lawsuit against the California Horse Racing Board will be dismissed.
BloodHorse reported that the ruling by San Diego Superior Court judge Ronald F. Frazier was dated Friday and allows no options for Hollendorfer to pursue additional claims.
Hollendorfer sued the board in 2020, the year after he was expelled from Del Mar following the deaths of multiple horses in his care in California.
Frazier already had denied two claims Hollendorfer made in his case against the CHRB, and Friday’s ruling denies the trainer’s third and final claim, that the CHRB violated a mandatory duty to protect against the risk of injury, causing Hollendorfer harm, BloodHorse reported. The judge ruled that Hollendorfer did not adequately allege the existence of such a duty.
Hollendorfer and California Thoroughbred Trainers sued Del Mar in 2019 in a case that is still pending. In that case, Frazier issued a temporary restraining order that allows Hollendorfer to race at the track.
All 67 of Hollendorfer’s starts this year have been at Monmouth Park or Oaklawn. Last year, he had 19 of 263 starts at Del Mar.
